A Federal High Court sitting in Kano has squashed the suspension of five lawmakers by Kano state House of Assembly declaring their suspension as null and void.

Galaxy correspondent King Richard, reports that Kano state House of Assembly had in March 2020, suspended five legislators over alleged misconduct and violation of house rules. 

During one of the house sittings in March, the assembly descended into chaos due to the submission of a report requesting the assembly to investigate allegations against Mohammadu Sanusi the second who was later deposed as emir of Kano. 

The suspended lawmakers, namely Isiyaku Ali Danja, Salisu Ahmed Gwangwazo, Garba Yau Gwarmai and Mohammed Bello Butu Butu had challenged their suspension before the court.

The plaintiffs in an originating summons urged the court to declare their suspension as a violation of section 109 of the 1999 constitution as amended, which clearly stipulates and guarantees their tenure in office.

The embattled lawmakers also argued that their suspension was a contravention of the African Charter on Human and Peoples’ Rights. 

The Speaker, Kano State House of Assembly urged the court to dismiss the request made to it by the plaintiffs.

In his ruling, the presiding judge, Justice Lewis Allagoa said the suspension of the lawmakers was a deprivation of their rights to participate freely in the affairs of the state, and granted the prayers sought by the suspended lawmakers.

The court also directed Kano State House of Assembly and the Speaker of the House to pay the withheld entitlements of the suspended lawmakers forthwith.
